In November 2015, the U.S. Citizenship and Immigration Services (“USCIS”) announced proposed changes to the Form I-9, Employment Eligibility Verification.  The proposed changes were submitted for public comment and following comments, the revised form was submitted to the Office of Management and Budget (“OMB”) for final review and clearance.  The USCIS recently announced that the OMB has approved the revised Form I-9, and that the revised I-9 will be published no later than November 22, 2016.

Here’s what you need to know:

 • Employers can continue using the current Form I-9 (available here: https://www.uscis.gov/i-9) through January 21, 2017.

• After January 21, 2017, employers must begin using the revised 1-9.

• Based on the proposed changes submitted for comment, the revised I-9 is expected to include a number of error-checking features intended to help employers reduce technical errors.

• The instructions for completing the form are expected to be separate from the I-9; however the fields will include “buttons” that will allow employers to access the instructions electronically.

• The revised I-9 is also expected to allow for employers to complete I-9s on their computer after they have downloaded the form from uscis.gov.
