UPDATE: New Form I-9 Must Be In Place For New Hires By This Sunday!

The deadline for mandatory use of the revised Form 1-9, used for verifying new hires identify and employment authorization is this Sunday, January 22, 2017. The latest version of the I-9 can be downloaded at the USCIS's website, available here: https://www.uscis.gov/i-9.

Among the changes in the revised version (which is dated 11/14/2016), Section 1 asks for “other last names used” rather than “other names used.” Other changes to the I-9 include the ability to enter multiple preparers and translators, a supplemental page for the preparer/translator, a dedicated area for including additional information, and increased compatibility and functions to make it easier to complete the form electronically. COUNSEL TO MANAGEMENT:

Again, employers should begin using the new I-9 immediately, but absolutely no later than this Sunday January 22, 2017. Employers do not need to reverify current employees due to the new form - only new hires need be verified using the updated form. Generally, the only documents that ever need to be reverified are temporary employment authorization documents (under Class C) that permit a person to work for a set period of time.

Further, although the USCIS’s website has promised an update to its Handbook for Employers: Guidance for Completing Form I-9 which was last revised in April 2013, an update has not been provided as of the date of this posting. We will provide that updated handbook when it becomes available.
