Trump Nominates Marvin Kaplan to the National Labor Relations Board

President Donald Trump has nominated Republican lawyer, Marvin Kaplan, to the National Labor Relations Board (“NLRB”).  Kaplan, whose past political roles included counsel for Republicans on the House Committee on Education and the Workforce, is currently counsel at the Occupational Safety and Health Review Commission.

Kaplan makes President Trump's second appointment to the NLRB, which had three vacant seats on the five-panel board at the time of his inauguration; the two occupied seats were Democratic appointees. President Trump is likely to appoint another Republican shortly.  With the likelihood of a Republican majority in the near future, it is expected that many Obama-era rulings may be reversed.

Business groups have already expressed their approval of the nomination, and Senator Lamar Alexander (R-TN) has said the Senate labor committee would act quickly to confirm the nomination.

COUNSEL FOR MANAGEMENT:
