UPDATE FROM DLSE: Employee Notice Of Rights For Victims of Domestic Violence, Sexual Assault and Stalking Applies to All Employers

We had previously reported on Wednesday that only employers with 25 or more employees are required to provide the above referenced notice. Since Wednesday, our office has been informed that the DLSE is interpreting the vague authorizing statute to mean all employers, regardless of size are required to provide employees upon new hire or upon request by other employees with the notice.  The notice sets forth the rights of employees of larger employers to take time off to seek medical attention for injuries, obtain services from a shelter, receive counseling or participate in safety planning due to domestic violence, sexual assault, or stalking.  The notice also describes previously existing rights applicable to all employers. As the Notice is clear on which rights apply to all employers vs. only employers of 25 or more employees, our office recommends following the DLSE’s guidance that all employers should provide the notice to avoid any enforcement issues with the DLSE.
