SB 95 COVID Leave Signed By Governor Newsom

Even if Your Workforce is Vaccinated, Mask Up!

As California continues to administer the COVID-19 vaccine to agricultural workers, it is important to remember that the State’s regulations are still in place and being enforced. In fact, Cal/OSHA is actively citing agricultural employers for failing to comply with these regulations. Even if most or all of your workforce is vaccinated, employers are still required to follow the following guidance in accordance with the Cal/OSHA Emergency Temporary Standards (“ETS”):

  • Employers must ensure that employees maintain at least six feet of distance from others;
  • Employers must provide employees with face coverings (or reimburse employees for the cost) and ensure they are worn over the nose and mouth when indoors and outdoors and within six feet of another person.

An employer FAQ on the ETS is available here. Cal/OSHA will continue to enforce the ETS until it gets updated instructions from the State.
